In response to the DOJ/DOT Joint Technical Assistance[1] guidance clarifying ADA Title II requirments issued last year, Caltrans proposed an implementation plan for the State’s Roadway Maintenance Program. In October 2013, FHWA approved the plan that required:

  • Compliance with all required ADA curb ramp work clarified the Technical Assistance for projects in the State’s highway maintenance program that will go out to bid for construction after July 1, 2014.
  • Modification of any on-call contracts to include the Technical Assistance guidance requirements on any future task orders.
  • Revisions to Caltrans’ project development procedures, roadway rehabilitation guidance, and highway maintenance guidance and manuals to incorporate all changes required by the alteration clarification. Provide the changes to the FHWA for review prior to December 30,2013.
  • Listing of all nonconforming curb ramps within resurfacing projects scheduled that go out prior to June 30, 2014 in the Caltrans ADA transition plan.

The Division of Local Assistance is currently developing an Office Bulletin to communicate the implementation dates to local agencies.
